1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Booxne mobile application ("App"). By downloading, installing or using the App, you agree to be bound by these Terms. These Terms apply to all users of the App, including users who access the App's features or content.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal Apple device(s) as permitted by the App Store Terms of Service. You may not:

• Copy, modify, distribute, sell or lease any part of the App
• Reverse-engineer or attempt to extract the source code of the App
• Use the App for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of the App or its related systems
• Use the App to infringe any intellectual property rights of third parties

3. In-App Purchases — Booxne Pro

The App offers a one-time in-app purchase called "Booxne Pro" which unlocks premium features including unlimited books, advanced statistics and library export.

• Payment: All purchases are processed by Apple via the App Store. You agree to Apple's payment terms at the time of purchase.
• One-time payment: Booxne Pro is a lifetime purchase. You pay once and retain access permanently, including future updates to Pro features.
• No refunds from us: All purchases are final and processed by Apple. For refund requests, contact Apple Support directly at reportaproblem.apple.com.
• Restore purchases: If you reinstall the App or switch devices, you can restore your purchase using the "Restore Purchase" button in the App settings, provided you use the same Apple ID.
• Free features: The free version of the App allows up to 5 books. We reserve the right to adjust free tier limits in future updates.
• Price changes: We reserve the right to change the price of Booxne Pro at any time. Price changes do not affect existing purchases.

4. User Content

The App allows you to create and store personal reading data including book entries, notes, ratings and goals ("User Content"). You retain full ownership of your User Content. By using the App, you grant us no rights to your User Content — it stays yours entirely. You are solely responsible for your User Content and represent that you have the rights to create and store such content.

5. Third-Party Services

The App integrates with third-party services including Google Books API and Open Library API to provide book search functionality. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, accuracy or availability of third-party services.

The App uses Apple's iCloud service for data synchronization. Your use of iCloud is subject to Apple's iCloud Terms and Conditions.

6. Intellectual Property

The App, including its design, code, graphics, logos and all related intellectual property, is owned by Booxne and protected by applicable intellectual property laws. The Booxne name, logo and all related names, logos, product names and slogans are trademarks of Booxne. You may not use them without our prior written permission.

Apple, iPhone, iPad, iCloud and App Store are trademarks of Apple Inc., registered in the U.S. and other countries. Booxne is an independent application and is not affiliated with, endorsed by or sponsored by Apple Inc.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, secure or free of viruses or other harmful components. We do not warrant that the results of using the App will meet your requirements.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOOXNE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR BOOXNE PRO.

9. Indemnification

You agree to indemnify, defend and hold harmless Booxne and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses, costs and expenses arising out of or in connection with your use of the App, your violation of these Terms or your violation of any third-party rights.

10. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us or third parties. Upon termination, your license to use the App ceases immediately. Termination does not entitle you to a refund of any in-app purchases.

11. App Store Terms

These Terms are in addition to, and not in lieu of, the Apple App Store Terms of Service. You acknowledge that these Terms are between you and Booxne only, not with Apple. Apple has no responsibility for the App or its content. In the event of a conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service shall prevail.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of France. If you are a consumer in the European Union, you may also have the right to refer disputes to your local courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. We will notify users of material changes through the App. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
